Brief of the case
The Commission had its sitting today to consider the compliance report of the Commissioner, Guwahati Municipal Corporation which was submitted in the Case No. KP(M)43/2007 (Shri Chittaranjan Chakraborty – vs- Commissioner, GMC).

On 23.11.07 the Commission while disposing the present case decided to direct the Commissioner, Guwahati Municipal Corporation under section 19 (8)(c) of the RTI Act, 2005 to inform the complainant the action taken on his petitions under GMC Act and Rules as found appropriate and in consequence with the submission made during the hearing on 23.11.07 and also the observations made by the Commission and report compliance.

The Commissioner, Guwahati Municipal Corporation in his compliance report stated that as per the observations of the Commission, unauthorized G.I. sheet W/C bath constructed by Sri Bijan Bhattacharjee & Smt. Bithi Bhattacharjee of Sreenagar, Bye-lane No.1, Guwahati has been demolished on 7th December 2007. The Commissioner, GMC also enclosed a copy of the notice of the GMC issued to Sri Bijan Bhattacharjee & Smti Bithi Bhattacharjee under section 337(3) of the Guwahati Municipal Corporation in which they were informed that the GMC had ordered to remove or pull down the unauthorized construction of the GIC sheets W.C. Bath. They were informed that the Corporation would demolish the unauthorized construction and cost of expenditure would be realized as arrear Municipal Tax.

The Commissioner, Guwahati Municipal Corporation also enclosed the report on demolition of W.C. bath constructed by them in which it was stated that the demolition of the illegal construction was carried out on 7.12.07.

Observation of the Commission
The Commission found that the order of the Commission given in this case on 23.11.07 was fully complied with by the Commissioner, Guwahati Municipal Corporation.

Decision of the Commission
The Commission on perusal of the report of compliance and on careful consideration of the facts and circumstances of the case decided to close the case as the order of the Commission dated 23.11.07 was carried out fully by the Commissioner, Guwahati Municipal Corporation.
