The Commission had its sitting today to consider the petition of Sri Brojen Kumar Bora of Guwahati praying for withdrawal of his letter dated 4.12.07 in which he brought to the notice to the Commission that he did not receive any response from the Resident Commissioner, Assam Bhawan, New Delhi to his three applications seeking information under RTI Act, 2005.

Brief of the case
On 4.12.07 Sri Brojen Kumar Bora of Guwahati submitted a petition to the Commission stating that he sent three applications seeking information from the Resident Commissioner, Assam Bhawan, New Delhi as to whether a letter dated 16.04.04 captioned ‘Issue of LPC’ from Bharati Bora (deceased) was received in his office and if so what action was taken thereof. Further, he sought for information on two letters dated 11.5.04 and 4.6.04 relating to non refundable GPF advance of Bharati Bora and about the letter dated 14.6.04 from the office of the Resident Commissioner and action taken on these two letters. He also vide letter his letter dated 26.10.07 sought information whether the letter dated 31.3.2007 captioned ‘whether statement of HBA/HUDCO Advance was received in his office or not and whether the matter was moved only after receipt of the Government letter dated 25.5.07 and whether his response dated 11.6.07 to his letter was considered appropriate.

The said application along with of copies of three letters dated 26.10.07 addressed to the Resident Commissioner, Assam Bhawan, New Delhi were transferred to the Commissioner & Secretary, GAD, Assam vide letter dated 1.1.08 by the Commission under section 6(3) of the RTI Act, 2005. Subsequently an application dated 19.12.07 was received from the applicant praying for withdrawal of his application dated 4.12.07 as he had received information from the Resident Commissioner, Assam Bhawan, New Delhi to his applications.

Observation of the Commission
The Commission observed that it was only a case of transfer of the petition of the applicant to the Resident Commissioner, Assam Bhawan, New Delhi and the time of 30 days had not elapsed as the application was sent only on 1.1.08 to the Resident Commissioner, Assam Bhawan, New Delhi and in the meantime the applicant had informed the Commission that he had already received the information.

Decisions of the Commission
In view of the above the Commission decided to allow withdrawal of the petition of the applicant which was submitted to the Commission on 4.12.07 and decided to close the case.
