The Commission had its sitting today to consider the petition of Sri Brojen Kumar Bora
of Guwahati praying for withdrawing of his letter dated 4.12.07 which he submitted before
the Commission.
Brief of the case
On 4.12.07 Sri Brojen Kumar Bora of Guwahati submitted a petition with copies of three applications purportedly sent to the Additional Chief Engineer, PHE (BV&AC) Guwahati in which he sought for the following information :
- Whether the office is functioning in PHE campus Bamunimaidan without a signboard?
- Whether it is a fact that none of officers have any name boards indicating their designated places?
- When can affirmative action be accepted?
- On what date(s) the sanction letters FEB 212/94/118 and FEB 212/94/117 both dated 27.9.06 from the Government of Assam in the Finance (Estt.B) Department regarding GIS payment in respect of Late Bharati Bora, Ex-FAO received in office?
- When were relevant bills sent to New Guwahati Treasury?
- Whether time gap between the two dates can be normal processing time?
- Whether two letters dated 15.11.2006 and 05.01.2007 both captioned “Refusal to Accept Letters” from this applicant was received in office?
- What action was initiated?
The Commission transferred the petition to the Additional Chief Engineer, PHE (BV&AC) Guwahati under section 6(3) of the RTI Act, 2005 on 1.1.08. On 26.12.07 a petition of the applicant praying for withdrawal of his letter dated 4.12.07 was received. Hence the Commission decided to sit today to consider the petition for withdrawal of the petition.
The Commission found that the petitioner submitted his petition to the Commission on 4.12.07 which was transferred to the Additional Chief Engineer, PHE (BV&AC) Guwahati on 1.1.08 and 30 days had not yet elapsed at which point of time the petitioner prayed for withdrawal of his petition dated 4.12.07 as he had already received the information.
Observation of the Commission
The Commission considered the matter and found that the information had already been provided to him on time and the Commission had no objection to the withdrawal of the petition by the petitioner.
Decisions of the Commission
In view of the above the Commission decided to allow withdrawal of the petition of the applicant which was submitted to the Commission on 4.12.07 and decided to close the case.
