The complainant absent. The CEO, Zilla Parishad, Cachar, the PD, DRDA, Cachar and the BDO, Sonai present. The Commission decided to hear the case ex-parte based on records.

Brief of the case
On 9.10.07 a petition was received from Md. Nazimuddin Bong (Barbhuiyan) of Sonabarighat in which he stated that on 17.8.07, he sought for information from the BDO, Sonai Development Block relating to IAY and other development scheme for the years from 2003 to 2006 under Krishnapur Gaon Panchayat. But he did not receive any information from the BDO Sonai. Hence this complaint case.

Submission of the parties
The BDO, Sonai Development Block submitted that he received the application of the petitioner on 17.8.07. On 5.9.07 the petitioner informed his office that as he was busy with some social flood relief works, he would not be in a position to collect the information.He also wanted to physically verify the schemes. On 20.9.07 he received an information form the Secretary, Dakhin Krishnapur Gaon Panchayat that all the information was already submitted to the petitioner on 19.9.97 and inspection was done by the petitioner.

Observation of the Commission:
The Commission observed that the BDO, Sonai Development Block, on receipt of the application of the petitioner asked the Secretary, Dakhin Krishnapur Gaon Panchayat to furnish him the information. As per Government notification No. RDD.258/2005/162 dated 23.9.05, the BDOs of the Development Blocks in the State were notified as the State Assistant Public Information Officers, while the Project Directors of the DRDAs in the State were notified as SPIOs. It was appreciated that the BDO, Sonai, instead of sending the petition to the PD, DRDA Cachar took the initiative to collect the information and furnish the same. The Commission wanted prompt disposal of the RTI matters iand'so long as the information sought for was made available to the applicants within the stipulated time, the objectives set forth in the Act would stand realized.

The Commission found that the petitioner who represented the Ten Brothers SHG had not only received the infornlation but also informed the BDO, Sonai Development Block that they had verified the schemes as per the information furnished and found them satisfactorily implemented. This was rather an unusual certificate issued by the petitioner.

Decision of the Commission:
As the information had already been furnished, the Commission did not deem it necessary to pass any order.
