The complainant present. Neither the District Elementary Education Officer, Dhubri nor the Public Information Officer of the office of the District Elementary Education Office, Dhubri was present. The complainant informs that he did not receive any information as sought for by him vide his petition dated 23.08.06 addressed to the District Elementary Education Officer, Dhubri.

The Commission finds that the District Elementary Education Officer, Dhubri and the Public Information Officer of his office have not shown any cause for their absence before the Commission although notices were issued to them on 9.10.06 for their appearance. As such the Commission deems it to be willful absence of the District Elementary Education Officer, Dhubri and the Public Information Officer of his office which is viewed very seriously by the Commission.

As such summons be issued to the District Elementary Education Officer, Dhubri and to the PIO of his office for appearance before the Commission on the next date fixed to show cause why penalties as contemplated under section 20 of the RTI Act, 2005 should not be imposed on them for their deliberate absence before the Commission today and for their failure to provide information to the petitioner.

Next hearing is fixed on 29.11.2006 at 11.30 A.M. in the office chamber of the Chief Information Commissioner.

Issue summons accordingly.
