The complainant present. The PIO of the Department of P&RD as well as the Joint Secretary of the Department present.

Brief Facts of the Case
The complainant submitted a complaint on 25.09.06 stating that although he submitted a petition to the Commissioner & Secretary, P&RD Department, Government of Assam on 22.8.06 he was not furnished with the information. As such the Commission issued a notice to the Commissioner & Secretary, P&RD Department on 9.10.2006 fixing 8.11.06 for hearing.

The information sought for by the complainant are as follows:

1. Whether the Government received any report under letter No. PDB 109/2001/75 dated 3.3.05.

2. What action was taken on receipt of the report (Action taken report be enclosed)?

3. If not received, how much time will be required?

4. What action has been / will be taken against the officer who made the delay?

5. At what stage is the Departmental enquiry ordered vide Govt. letter No. PDB.186/2002/Pt/30 dated 4.3.05 (copy of the report be enclosed)?

6. In pursuance to the letter No. BCA.2/2003/Pt/252 dated 28.2.05 of SDO(C) Bilashipara, Nurul Ajam Sarkar was transferred. What action was taken against him for his corruption (copy of the action taken enclosed)?

The Joint Secretary of the Department states that the Department has furnished information pertaining to points from 1 to 5. The Commission wants to know from the Joint Secretary when the enquiries as referred to point 4 and point 5 will be completed. The Joint Secretary states that as per Rules any Departmental enquiry is to be completed within 3 months and so he wants 3 months period more for completion of the enquiries. The Joint Secretary hands over a copy of the report of the enquiry relating to point 6 of the complaint as the complainant did not receive the report.


Decision of the Commission:

The Commission, on hearing both the parties and on careful consideration of the facts and circumstances of the case do hereby direct that the Departmental enquiries relating to point 1 and point 6 be completed within 3 months from today.
