Brief of the case
The Commission received the petition of Sri Tarun De)' in which it was stated that inspite of the direction of the Commission to the SSP, City, Guwahati to furnish a copy of the FIR and a copy, of the petition withdrawing the FIR by his wife Smti Jhama Choudhury he did not furnish the same. Accordingly a notice was issued to the SSP City to appear before the Commission for hearing.

Submission of the SSP,city
The SSP City submitted before the Commission in writing and verbally that pursuant to the direction issued by the Commission in their order dated 6.6.07 in this case, a certified copy of the FIR dated 12.9.2006 and certified copy of the withdrawal petition of FIR dated 13.9.2006 were handed over to Sri Tamn Dey on 29.6.07. The complainant acknowledged receipt of the same by putting his signature' on the body of the photo copy of the certified copies of the FIR and the withdrawal petition; He however, submitted that the system of disposal of RTI applications / RTI matters in his office was not up to the mark before his joining and as such the RTI applications / orders of the Commission were not put up to him by his office promptly. After his joining he systemized the procedure of receipt of the RTI applications, disposal of RTI applications and also appointed the Additional SP (HQ) as the SPIO. He admitted that the delay was caused in this regard and he had taken adequate steps to ensure that such delays would not. occur in future. He regretted the delay and prayed for condoning the delay.

Observation by the Commission
The Commission observed that the Police Headquarters, Assam had already issued notification notifying the SSP, City as the SPIO of his office and the IGP (A) Assam as the First Appellate Authority. As such it was not necessary to designate Additional SP (HQ) as the SPIO of his office. The SSP City shoukl take step to cancel the order. The Commission also wanted the SSP City to ensure streamlining of the system of the disposal ofRTI applications, easy receipt of cash as fees an~ cosumd timely disposal of the RTI applications in his office. The Commission felt that as the S-SP'City is a busy officer the Assistant SPIO of his office should be more active and take adequate steps to streamline the system of disposal of RTI applications and open a separate receipt register for the RTI application / appeals so that the members of the public do not have to go away without depositing applications / appeals/fees/cost etc. Notice boards at the prominent places in his office showing the names / designation of SPIO / ASPIO along with details of fees, costs for information should be put up in his office for guidance of the public.

Decision of the Commission
The Commission on careful consideration of the facts and circumstances of the case decided to close the case as the SSP City had already furnished the copies of the FIR and the withdrawal petition of FIR as sought for by the complainant.
