Ali Akbar Mia submitted a complaint before the Chief Information Commissioner on 2.9.06 stating that although he submitted a petition to the SDO(C) Bilasipara under the Right to Information Act, 2005. He did not receive any information from the SDO(C) Bilasipara as such he submitted the complaint before the Commission. Hence this case. He wanted the following information:

1. How many landless and erosion affected people had applied for allotment of ceiling surplus and khas land measuring 1086 bighas in Bilasipara circle in Kathladi no. 1,2,3 part.

2. (a) Did any court order was received for allotment of 69 bighas 2 katha and 2 lechas for allotment amongst the illegal persons in Kathaladi 1st part .
(b) How many encroachers have been allotted the land

3. (a) How much of the land was allotted to Bilasipara Mahakuma Char Development Samitee and possession thereof?
(b) How much land was sought by the Samittee for allotment amongst the unemployed youths.
(c) Are the encroachers on this land have been evicted, if not, how much time will be required.

4. Was there any order received from the Court for not giving the allotment of these landless and erosion affected people.

The Commission was informed by the SDO (C) that as the petitioner did not pay the application fee the information was not supplied to him but the information was ready at present and this could be furnished to the complainant within 20th of this month.

Decision of the Commission

The Commission on careful consideration of the facts and circumstances of the case accept the cause for delay in furnishing the information and orders that the information as sought for by the complainant should be furnished to him free of charge within 20.11.2006 positively.
