Decision of the Commission
1. The Commission has gone through the petition of Shri Bakul Ch. Nath carefully. It appears, the
petitioner submitted several petitions before the GMC seeking for information but not a single
petition has been disposed of by the GMC and no information was furnished to the petitioner.
2. The Commission noted the absence of the Commissioner, GMC with concern and would like to make it
clear that the provision of Section 180) (a) will be applied to compel his presence if he failed to
attend the hearing in future. As the petitioner was also absent without intimation, the Commission
did not deem it necessary to take recourse to the punitive provisions of the Act against the
Commissioner, GMC. It also seemed that the petitioner did not submit any petition to the GMC
so far directly under the RTI Act.
3. Therefore, the Commission, on careful consideration of the facts of the case decided to transfer
the petition of the petitioner along with the fees under Sec. 6(3) of the RTI Act, 2005, with the
direction to the Commissioner, GMC to furnish the information within the stipulated time as laid
down under Section 7 of the Act.
