Brief of the Case

The Complainant wanted the following documents:

(i) Conferring selection grade in IPS to him in 1975.
(ii) The promotion order as the Deputy Inspector General of Police on 25.8.1978.
(iii) Order of upgrading the post of the Deputy Inspector General of Police in the Home Guard to the Deputy Inspector General of Police in the police department.

The SPIO stated that the information as sough for by the Complainant is not available as the case related to 1975 records. The Deptt. had written to the A.G. Assam and also DGP Assam. No reply has been received from AG Assam while DGP has informed that the records could not be traced out. The SPIO stated that she would contact the AG Assam personally and to get the information. The SPIO submitted that as the information is more than 25 year old the connected records might have been transferred to the record room of the Secretariat.

The PIO requested for time to locate the documents and also to obtain the same from AG Assam by personally visiting that office.

Decision of the Commission

The Commission has considered the matter in its entirety. The PIO is directed to trace out the documents within one month and inform the petitioner and the Commission. In case the PIO is unable to locate the documents, the Commission will be constrained to take action U/S 19(8)(b) of the RTI Act for which the hearing is fixed on 29/1/07 at 11-30 AM. However if the information is furnished to the petitioner within the period the matter will be treated as closed.
