Brief of the case

On 07.03.07 a petition was received by the Chief Information Commissioner from Salim Ahmed, Bawluri, district Dhubri to the effect that he applied for some information before the PIO, Deputy Commissioner's Office, Dhubri seeking copies' of plan and estimate for Cage Fish Culture by using net at Jaleswar area under District Development Plan for 2006-07 under the provisions of RTI Act, 2005. The concerned PIO of D.C's Office, Dhubri sent his petition to the District Fishery Development Officer, Dhubri vide his letter dated 17.1.07 but the concerned District Fishery Development Officer, Dhubri did not provide with the required information. Hence his complaint case.

Submission of the District Fishery Development Officer, Dhubri

The complainant was absent without steps. Shri B.K. Sarma, District Fishery Development Officer, Dhubri present.

The District Fishery Development Officer submitted before the Commission that he received the petition of the complainant on 17.1.07 from the PIO of DC's office Dhubri. He sent the information along with the plan and estimate for Cage Fish Culture to the complainant on 23.2.07. On receipt of the notice from the Commission, the District Fishery Development Officer again sent a copy of the information by a special messenger on 25.2.07.

Decision of the Commission

The Commission on careful consideration of all the facts and circumstances of case decided to hear the case as ex-parte. On perusal of the records produced by the District Fishery Development Officer, Dhubri the Commission was satisfied that the District Fishery Development Officer, Dhubri sent the required information to the complainant and hence the Commission decided to treat this case as closed.
