The complainant absent without intimation. The Additional Chief Engineer, PWD Roads (P), Assam along with three others present on behalf of the Public Authority.

Brief of the case

On 5.3.07 a petition was received from Shri Hari Prasad Agarwala by the Chief Information Commissioner in which he stated that he did not receive the information sought for from the Public Information Officer, office of the Chief Engineer PWD, Roads Assam, Guwahati vide his letter dated 14.11.06 sent to the PIO by registered post. He sought for the following information:

i) Why the State Government is not releasing the fund?
ii) When the State Government will release the fund?
iii) How many times the PWD has been communicating with the State Government for seeking fund since last six years?
iv) What was the letter No. & date of the last communication by the PWD for fund with State Government?
v) Has the State Government / PWD identified the concerning officer for not releasing the fund in this long period?
vi) Has the State Government / PWD taken any legal action against the concerning officer?
vii) Is there any provision in the law that the suffering contractors may take legal action against the liable officer?
viii) What is the name, designation & address of the liable officer? Who has took the concerning file of fund since long run without any movement of said file?

Hence this case.

Submission of the parties

The Additional Chief Engineer, PWD, Roads submitted before the Commission that the information sought for by Shri Hari Prasad Agarwala was furnished to him vide letter dated 28.12.06 by the Executive Engineer, PWD, Dhubri (Rural Road) Division, Dhubri. The letter was sent by the registered post from the office of the Executive Engineer, PWD, Dhubri (Rural Road) Division, Dhubri in the address furnished by Shri Agarwala.

Decision of the Commission

The Commission decided to hear case ex-parte in the absence of the complainant. On careful consideration of the facts and circumstances of the case and after perusing the reply sent by the Executive Engineer, PWD, Dhubri (Rural Road) Division, Dhubri the Commission is of the opinion that the information has been dully furnished to the petitioner. Hence the matter is treated as closed.
