Brief of the Case

Shri Prakash Deka, the complainant submitted a petition before the Chief Information Commissioner on 16.2.07 stating that he applied before the PIO of Department of Education for some information which he has not been able to obtain from the PIO. The information sought for are as follows:

1. A photo copy of Assembly Question and the replies to questions of Dr. M.R. Das, MLA by the Education Minister in respect of Sri S.N. Sarma, then DAED, Kamrup under suspension who is recently reinstated as Asstt. Director, in the Directorate of N.F & Adult Education Assam, Guwahati-5.

2. Photo copies of the note pages / office orders of the File No. ASE.482/2006/Pt. in respect of reinstatement of Sri S. N. Sarma.

Hence this complaint case.

Submission of the Commissioner & Secretary Education Deptt

The Commissioner & Secretary, Education Department submitted that the PIO has already given the information on 19.2.07 after asking the petitioner to deposit the cost on 5.2.07. He expressed regret that there was some delay and promised that he would take steps to streamline the procedure of disposal of petitions under the R. T.I. Act, 2005.

Decision of the Commission

As the information has already been furnished to the complainant, the Commission has decided to treat the matter as closed.

The Commission however observed that the disclosures under Section 4 of the RTI Act had not been prepared by the Education Department so far. The Commission advised the Commissioner & Secretary, Education Department to prepare the same and hoist it in the website and inform the Commission
