Brief of the case
The complainants submitted a petition on 15.6.07 in which it was stated that he sought for information from the DC, Morigaon who sent the petition to the PD. DRDA, Morigaon. But till this date the information sought for was not furnished. The information sought for related to the implementation of the SGRY - II, IAY, Special Fund and Randhan Jyoti Schemes for Burgaon Gaon Panchayat as they suspected that the schemes were not implemented properly.

Submission of the DC Morigaon
The PD, DRDA, Morigaon submitted that he. had already furnished the information which was received by Shri Rananjoy Biswas, the first applicant after due acknowledgement. Hence there was no cause for a complaint and hence the case be dropped.

Observation of the Commission
The Commission observed that as per Section 3 of the RTI Act 2005, all citizens shall have the right to information but as per Section 6 (1) of the Act, a citizen has to apply individually and not collectively. Though the information was already furnished to the first petitioner who however, did not inform the other petitioners, as a measure of public service the PD, DRDA, Morigaon might also furnish another set of the information to them although the PD was not legally bound to furnish it. As the PD, DRDA, Morigaon volunteered to give a copy, the Commission welcomed it.

Decision of the Commission
The Commission, on careful consideration of the facts of the case decided to close the case.
