The Commission in its hearing on 17.7.2007 ordered penalty at the rate of Rs. 250/- per day w.e.f 25.5.07 to the Principal, Karimganj College for his failure to furnish information to the complainant. The Commission further ordered that the Principal should furnish the information latest by 24.7.2007 and file an affidavit of compliance with further submission why the Commission should not execute the order of penalty

The Commission has received the sworn affidavit from the Principal. He has mentioned in the affidavit that the information has been furnished to the complainant on 20.7.07. The Principal has also submitted that the delay was unintentional and without any mala fide. He was trying to collect the information, from various offices and also consulted the Government pleader as he was not thorough with the RTI Act, 2005. He has expressed regrets for the delay and sought to be excused.

The Commission again considered all aspects of the matter in view of the further submission of the Principal. The Commission feels that the Principal has shown his sincerity in furnishing the information within the time stipulated by the Commission.. As he has also expressed sincere regrets, the Commission is pleased to rescind the order of imposition of penalty on him with the warning that he should not repeat such mistake in future in the implementation of the RTI Act.

This matter is laid to rest with these orders.
