Brief of the case
On 17.5.07, a petition was received by the State Chief Information Commissioner from Shri Moti Ram Nath of Garoimari of Darrang that he did not receive any information from the DEEO, Darrang in reply to his petition dated 9.4.07. Information sought for were as follows:

(1) Shri Aditya Das and Shri Kumud Das were accused in murder case. A criminal case is under trial in Mangaldoi Court. There is also a case in Sipajhar P.S. against them as accused in murder case. The case number of said Court case be furnished.

(2) Shri Aditya Das was detained in jail for 6 months for murder and Shri Kumud Das was absconding for 6 months. Why was Shri Aditya Das not placed under suspension? Reply be furnished from the former DEEO Shri Ratul Bora.

(3) Why was Shri Kumud Das, an accused in murder case and an absconder for 6 months not placed under suspension? Reply be furnished from former DEEO Shri Ratul Bora.

(4) How are these persons who are accused in murder case serving as teachers?

Submission of the parties
The complainant stated that he had received information relating to Shri Aditya Das. But he had not received information relating to Shri Kumud Das. The Deputy Inspector of Schools stated that the information was ready and would be furnished to the complainant on 12.7.2007.

Observation by the Commission
The Commission observed that if the complainant was not satisfied with the information furnished relating to the criminal case he might approach the S.P., Darrang.

Decision of the Commission
The Commission on careful consideration of the facts and circumstances of the case directed the DEEO, Darrang to furnish information to the complainant on 12.7.2007. The complainant might feel free to approach the Commission in case he found that the information furnished to him was not sufficient
