Brief of the case
Shri Jitendra Nath Gogoi submitted a complaint -on 23.5.07 stating that he sought information relating to Deochutal Stone Mahal No. 'A' from the SPIO of the office of the - Chief Principal Conservator, Assam, Guwahati but he did not receive any information within the stipulated time of 30 days. The information sought for are as follows:

(1) The boundaries of Deochutal Stone Mahal No. 'A' for which the Mahal was settled, name ofthe Mahaldar.

(2) Distances from PWD road, school, ASEB lines, residential houses- village,agricultural field to the said Mahal.

(3) Steps taken to control pollution due to blasting and steps to mitigate the sufferings.

Submission by the parties
The Complainant submitted that he did not receive the information sought for by him from the SPIO and hence he filed this complaint.The SPIO submitted that he received the application on 19.3.07 and on the same day, he sent it to the DFO West Division. He obtained the information from DFO West Division on 27.3.07 and he sent the information on 9.4.07 by post. He also showed the issue register. He stated that he has mai~tained a separate receipt - register for R TI applications which he showed to the Commission. He also showed the reply to the complainant and the complainant expressed his satisfaction.

Observation of the Commission
The Commission perused the records including the issue register and docket register for R TI applications and expressed its satisfaction for proper maintenance of records on R TI matters. The Commission was satisfied that the information was sent in time by post but the petitioner did not receive the same. .

Decision of the Commission
The Commission on a careful consideration of the facts and circumstances of the case decided to direct the SPIO to furnish a copy of the information to the petitioner on realization of the cost from the petitioner, within 3 days of the r~ceipt of this order.
