The complainant accompanied by four others present. The Assistant Executive Engineer, PWD (Roads) Golaghat present who represents the Executive Officer PWD (Roads) Golaghat. The Assistant Executive Engineer, PWD (Roads) Golaghat submits that the Executive Engineer PWD (Roads) Golaghat is not the PIO but he has been designated as APIO. The Superintendent Engineer PWD (Roads) Jorhat is the PIO of PWD.

As such, the Executive Engineer, PWD (Roads) Golaghat who is the APIO should have sent the petition of Shri Akhil Gogoi, the petitioner to the Superintending Engineer, PWD (Roads) Jorhat for furnishing the information. Instead, the Executive Engineer, PWD (Roads) Golaghat sought for permission of the Superintending Engineer, PWD (Roads), Jorhat for furnishing the information. However. The Executive Engineer, PWD (Roads) furnished some information vide letter dated 7.9.06

The complainant Shri Akhil Gogoi states that the list of schemes as furnished to him is not complete as the roads in Golaghat town are not included in the list. Moreover, some of the details have not been furnished to him.

It is made clear to the Assistant Executive Engineer, PWD (Roads) Golaghat that information as asked for has to be furnished to the complainant free of cost as the public authority has failed to provide information on time.

Decision of the Commission:

Neither the PIO nor the Public Authority is present. Only the Assistant Executive Engineer PWD (Roads) Golaghat is present. The Commission takes adverse notice of the absence of PIO Superintendent Engineer PWD (Roads) Jorhat and the Executive Engineer PWD (Roads) Golaghat. The Commission directs the complainant to submit a petition to the Executive Engineer, PWD (Roads) Golaghat stating clearly in detail what further information is required by him. On receipt of the petition of the complainant, the Executive Engineer, PWD (Roads) Golaghat shall send the petition to the Superintending Engineer PWD (Roads), Jorhat. In the meantime, the Executive Engineer, PWD (Roads) Golaghat shall compile the information as sought for and send the same to the Superintending Engineer, PWD (Roads), Jorhat who on being satisfied shall furnish the same to the complainant within 30 days of the receipt of this order. In case the complainant is not satisfied with the information, he may approach the Commission for further action.
