The complainant present. The Principal Secretary (N) N.C. Hills Autonomous Council was also present.

Brief of the case
The complainant first submitted his petition under the R TI Act before the Secretary, IIC Revenue, N.C. Hills Autonomous Council, Haflong on 14.2.07. On not receiving information, he submitted a petition before the Principal Secretary of the Council as the first appeal on 21.3.07. On not receiving any information even from the 1st Appellate Authority, he preferred an appeal before the Commission on 8.5.07. Hence this complaint case

Submission by the parties
The complainant submitted before the Commission that he received the list of affected families from the Revenue Officer (W), N.C. Hills Autonomous Council, Haflong after he deposited Rs. 272 on 21.6.07 by bank draft. He submitted that the addresses of the families receiving compensation as well as their fathers' names are not there. Moreover, the names of some villagers are left out viz. Mrs. Prasaindi of Boro - Wapu village are not given compensation.

The Principal Secretary (N) of the Council submitted that there is Secretary lIC Revenue in the Council who deals with revenue matters. He stated that he would ask the Secretary IIC Revenue to furnish the information. He also submitted that the Principal Secretary (T) ofthe Council asked the SPIO to seek time from the petitioner.

Observation of the Commission
The Commission perused the information furnished to the complainant. It transpires that the complete addresses of the persons receiving compensation for acquisition of land for construction of National Highway in N.C. Hills were not furnished. Also fathers' names of these persons were not mentioned.

Decision of the Commission
The Commission on careful consideration of the facts and circumstances of the case decided to direct Shri K. Jemi , Principal Secretary (N), N.C. Hills Autonomous Council to hear the complaint treating the appeal pending with him as the First Appeal under the RTI Act, 2005. After hearing the complaint he should furnish the complete information to the complainant within a month. The complainant on getting the information from the Principal Secretary, N.C. Hills Autonomous Council if not satisfied may feel free to submit a complaint before the Commission. A report of compliance shall be sent by the Principal Secretary (N), N.C. Hills Autonomous Council to the Commission within 6.8.07.
