Brief of the Case

The Complainant Shri Bajrang Agarwal submitted a petition before the Chief Information Commissioner, Assam which was received on 21-11-06. The Complainant submitted that the he submitted applications to the Food & Civil Supply Deptt. in the year 1990 regarding malpractices adopted and indulgence given by the Food Corporation of India officials by deliberate and planned, illegal and irregular activities leading to heavy damage to contractors and national loss by misappropriation and manipulation of records in weighment of goods, by taking under-weight quantities in railway wagons by making excess stocks for disposal by smuggling for personal gains and by engaging favourite contractors illegally at high rates by ad-hoc limited tender system.

The SPIO informed the Commission that the applications as referred to in the petition under the RTI Act are not traceable in the deptt.. But the deptt, sent the application of the complainant to the Food Corporation of India. The FCI has already sent a reply to the complainant a copy of which has been received by the deptt.

The Complainant wanted to know about the action taken by the govt. against the FCI officials. As the matter relates to the Govt. of India, the complainant has been advised to take the matter with the Govt, of India and Central Information Commission as the FCI is a Central Govt. undertaking and the State Information Commission does not have jurisdiction to take up such cases.

Decision of the Commission

The Commission, in view of the above, treats the case as closed.
