Brief of the Case
On 3.5.07 a petition was received under section 18 of the RTI Act, 2007 from Smt Sabitri Narzari village No.2 Thaigirguri, P.O. Koila Moila, dist- Chirang for her failure to get a copy of the motor accident report in prescribed format under C/W Dergaon Police Station Case 244/06 from the O.C Dergaon Police Station although she applied by registered post to the O.C. Dergaon Police Station under section 6(1) of the RTI Act for getting copy of the motor accident report and enclosed a court fee of Rs.10/- . She also submitted an appeal to the First Appellate Authority, the Superintendent of Police, Golaghat district. Hence this case.

Submission of the parties
The S.P. Golaghat informed that the accident report of late Umesh Boro of Bijini was duly received by Shri Binod Kr. Basumatary on 15.6.07. Before that on 12.1.07 Shri Ashim Boro, Advocate of the Smt Sabitri Narzari received the motor accdident report and the copy of the FIR in C/W motor accident on behalf of the petitioner. As such there was no delay in the matter.

Decision of the Commission
The Commission on perusal of the records produced by the SP, Golaghat was satisfied that the information as sought for by the petitioner was received by the advocates of the petitioner and hence it was not deemed necessary to give any direction to the public authority.
