Brief of the Case
Shri M N Nath. Advocate, Gauhati High Court, Guwahati submitted a complaint on 15.11.06 under Section 18 of the Right to Information Act, 2005 for not furnishing information under section 6 (1) of the said Act by the State Public Information Officer of the Information & Public Relation Department, Dispur.

He sought information from the SPIO regarding appointments made in the Heads of Department, Government of Assam in Guwahati as per direction of the Government of Assam vide circular No ABP 28/97/59 dated 04.08.1997 issued by the Personnel (B) Department.

Heard the complainant. Heard the SPIO of the Information & Public Relation Department.

The SPIO confirms that he has furnished the information and the complainant also acknowledges receipt of the same. The SPIO expresses regret for the delay in furnishing the information as the information has to be collected from the Directorate and submits that the delay in furnishing the information is not intentional.

Decision of the Commission
As the complainant prays for further time to study the information furnished, the Commission agrees to give time.

In case the complainant wants further clarification from the SPIO or wants to prefer an appeal before the 1st Appellate Authority he may feel free to move the SPIO / 1st Appellate Authority accordingly. The Commission further directs that as the information was not furnished in time, no fees be realized from the complainant.
