The complainant absent. Smt. A. Saikia, ADC, Nagaon & PIO along Shri S.S. Meenakshi Sundaram, IAS, SDO (C), Hojai, Shri Parag Kr. Kakaty, EAC, Hojai and the DPO (ICDS), Social Welfare Department, Nagaon are present.

Heard the Public Information Officer of the office of the Deputy Commissioner, Nagaon. She has submitted that the petition was forwarded to the SDO(C), Hojai for furnishing the information of the complainant from his end. The SDO(C), Hojai offers unconditional and unqualified apology for the delay and for the non submission of the information in time.

The Commission has perused the documents and it is seen that the subject matter of the petition of the complainant addressed to the Deputy Commissioner, Nagaon relates to the Social Welfare Department as he (the complainant) wanted information regarding construction of ICDS centre. But the PIO of the office of the Deputy Commissioner, Nagaon has wrongly sent the application to the SDO(C), Hojai instead of sending to the District Social Welfare Officer, Nagaon.


Decision of the Commission:

The PIO of the office of the Deputy Commissioner, Nagaon as well as the SDO(C), Hojai pray for time for furnishing the information as the provisions of the RTI Act, 2005 are not known to them fully. Hence the Commission decides to give 15 days time to the PIO of the office of the Deputy Commissioner, Nagaon to furnish the information to the complainant failing which penalty as contemplated under section 19 (1) of the RTI Act 2005 shall be imposed on the PIO of the office of the Deputy Commissioner, Nagaon and the Public Authority (D.C. Nagaon)

Issue notices to the D.C. Nagaon / PIO of his office and the complainant.
Fix 4.12.2006 at 11.00 AM for hearing.
